Here I explain what personal data I process when you use williamfogg.es or get in touch with me, what I use it for and what rights you have, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
Basic information (contact form)
Controller: Guillermo Martínez Sánchez (William Fogg Asesor Personal de Viajes)
Purpose: To handle your enquiry about a trip and assess whether I can design it
Legal basis: Your consent
Recipients: Technology providers that allow me to receive your message; I do not share your data with third parties for any other purpose

1. Data controller

I have not appointed a data protection officer, because I am not required to do so under the regulations.
2. What data I process, why, on what basis and for how long
Contact by form, WhatsApp or phone
Data: What you give me: your name, contact details and what you tell me about your trip
Purpose: To answer your enquiry and assess your trip
Legal basis: Consent (Art. 6.1.a GDPR)
Retention: Five years from the last contact, or until you ask for it to be erased
Booking and managing the trip
Data: Travellers' data: identification, passport, contact details, preferences
Purpose: To design, book and accompany the trip
Legal basis: Performance of a contract or pre-contractual measures (Art. 6.1.b) and legal obligations (Art. 6.1.c)
Retention: For as long as the relationship lasts and, afterwards, for the legal retention and limitation periods
Travel notes (newsletter)
Data: Email address
Purpose: To send you one travel note a month
Legal basis: Consent (Art. 6.1.a)
Retention: Until you unsubscribe
Web analytics (Google Analytics)
Data: Pseudonymous identifiers from the analytics cookies, pages viewed, the five measured actions (a click on WhatsApp, a click on the phone number, sending the form, subscribing to the travel notes and viewing a destination page), the source of the visit or campaign, and approximate device, browser and location data. It does not include your name, your email or the content of your messages
Purpose: To understand how the site is used and improve it, and to measure the results of my campaigns
Legal basis: Consent (Art. 6.1.a GDPR and Art. 22.2 LSSI-CE). It is only switched on if you click "Accept" in the cookie notice
Retention: Cookies, up to 2 years; data in Google Analytics, 14 months
Site operation and security
Data: Technical connection data, such as your IP address and browser
Purpose: To serve the site and protect it from misuse
Legal basis: Legitimate interest (Art. 6.1.f)
Retention: The period the hosting provider applies to its technical logs
Giving me your data is voluntary. The fields marked as mandatory in the form are necessary for me to handle your enquiry; without them I cannot reply.
If you give me health data, such as mobility needs or allergies, so that I can adapt a trip, I process it only with your explicit consent (Art. 9.2.a GDPR) and solely for that purpose.
3. Recipients and international transfers
I do not sell or share your data for commercial purposes. I only disclose it to:
Technology providers, acting on my behalf: Vercel Inc. (site hosting and receipt of form messages, United States), Brevo (Sendinblue SAS, France), which sends the travel notes, and Google Ireland Limited (with the support of Google LLC, United States), which provides Google Analytics only if you accept analytics cookies.
WhatsApp, if you write to me through that channel. The service is provided by WhatsApp Ireland Limited, part of the Meta group, which is governed by its own terms.
Trip suppliers, only if you book: hotels, local operators, airlines and insurers, to the extent strictly necessary to perform the contract. Some are in countries outside the European Economic Area, and that transfer is based on the need to perform the contract (Art. 49.1.b GDPR).
Public authorities, when the law requires me to.
Technology providers located in the United States, Vercel Inc. and Google LLC, process data under the safeguards of the EU-US Data Privacy Framework or standard contractual clauses.
4. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability at any time. If you have given your consent, you can withdraw it whenever you like, and doing so is as easy as giving it. Withdrawal does not affect processing carried out beforehand. If you have accepted analytics cookies, you can withdraw that consent at any time by clicking "Configurar cookies" at the foot of any page.
To exercise them, write to me at will@williamfogg.es or at the postal address above, identifying yourself and stating the right you wish to exercise. I will reply within one month at most.
If you believe I have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).
5. Automated decisions
I do not make decisions based solely on automated processing, and I do not profile you.
6. Security
I apply reasonable technical and organisational measures to protect your data against unauthorised access, loss or alteration.
7. Children
The site is not aimed at children under 14, and I do not knowingly collect their data. If a trip includes children, their data is provided by their parent or guardian.
8. Changes to this policy
I may update this policy to reflect legal or site changes. The date of the last update is shown at the top.
